| Privacy Policy
The Department of Toxic Substances Control, Registered Environmental Assessor Program (REA Program), is committed to the free flow of information to ensure that consumers can identify and contact qualified environmental professionals. The REA Program is also committed to promoting and protecting the privacy rights of individuals, as enumerated in Article 1 of the California Constitution, the Information Practices Act of 1977, and other state and federal statutes. It is the policy of the REA Program to limit the collection and safeguard the privacy of personal information collected or maintained by the REA Program. The REA Program's information management practices are consistent with the Information Practices Act (Civil Code Section 1798 et seq.), the Public Records Act (Government Code Section 6250 et seq.), Government Code Sections 11015.5 and 11019.9, and with other applicable laws pertaining to information privacy. The REA Program follows these principles in collecting and managing personal information: - Personal information is collected from individuals only as allowed by law. We limit the collection of personal information to what is relevant and necessary to accomplish a lawful purpose of the REA Program. For example, we need to know an applicant’s address, telephone number and social security number, among other things, to properly identify the person before registration. Personal information, as defined in the Information Practices Act, is information that identifies or describes an individual including, name, social security number, physical description, home address, home telephone number, education, financial matters, and medical or employment history.
We do not collect home, business or e-mail addresses, or account information from persons who browse our Internet sites. We collect personal information about you only if you provide it to us voluntarily through e-mail, registration forms, or surveys. - We tell people who provide personal information to the REA Program the purpose for which the information is collected. We tell persons who are asked to provide personal information about the general uses that we will make of that information. We do this at the time of collection. With each request for personal information, we provide information on the authority under which the request is made, the principal uses we make of the information and the possible disclosures we are obligated to make to other government agencies and to the public.
- Anyone providing personal information has the opportunity to review that information. The REA Program allows individuals who provide personal information to review the information and contest its accuracy or completeness.
- Personal information is used only for the specified purposes, or purposes consistent with those purposes, unless we obtain the consent of the subject of the information, or unless required by law or regulation. The Public Records Act exists to ensure that government is open and that the public has a right to have access to appropriate records and information possessed by state government. At the same time, there are exceptions in both state and federal law to the public's right to access public records. These exceptions serve various needs including maintaining the privacy of individuals. In the event of a conflict between this Policy and the Public Records Act, the Information Practices Act or other law governing the disclosure of records, the applicable law will control.
- We use information security safeguards. We take reasonable precautions to protect the personal information on individuals collected or maintained by the REA Program against loss, unauthorized access, and illegal use or disclosure. Personal information is stored in secure locations. Our staff is trained on procedures for the release of information, and access to personal information is limited to those staff whose work requires it. Confidential information is destroyed according to the REA Program's records retention schedule. The REA Program conducts periodic audits to ensure that proper information management policies and procedures are being followed.
Information Collection, Access and Disclosure The Information Practices Act, Sec. 1798.17 Civil Code, requires the following information to be provided when collecting information from individuals. Box 806 Sacramento, California 95812-0806 TELEPHONE NUMBER: (916) 324-6881 AUTHORITY WHICH AUTHORIZES THE MAINTENANCE OF THE INFORMATION: Section 25570.3, Chapter 6.8, Division 3, of the State Health and Safety Code. THE CONSEQUENCES OF NOT PROVIDING ALL OR ANY PART OF THE REQUESTED INFORMATION: It is mandatory that you provide all information requested. Omission of any item of requested information will result in the application being rejected as incomplete. THE PRINCIPAL PURPOSE(S) FOR WHICH THE INFORMATION IS TO BE USED: The information requested will be used to determine qualifications for registration, licensure, or certification to determine compliance with the group and corporate practice provisions of the law and to establish positive identification. ANY KNOWN OR FORESEEABLE DISCLOSURES WHICH MAY BE MADE OF THE INFORMATION: Your completed application becomes the property of the agency and will be used by authorized personnel to determine your eligibility for registration. Information on your application may be transferred to other governmental or law enforcement agencies. Pursuant to the California Public Records Act (Gov. Code Section 6250 et seq.) and the Information Practices Act (Civ. Code Section 1798.61), the names and addresses of persons possessing a license or registration may be disclosed by the department unless otherwise specifically exempt from disclosure under the law. Consequently, the personal name and address information entered on the attached form(s) may become public information subject to disclosure. SOCIAL SECURITY NUMBER DISCLOSURE Disclosure of your social security is mandatory. Section 30 of the Business and Professions Code and Public Law 94-455 [42 U.S.C.A. Section 405(c)(2)(C)] authorizes collection of your social security number. Your social security number will be used exclusively for tax enforcement purposes, for purposes of compliance with any judgment or order for family support in accordance with section 11350.6 of the Welfare and Institutions Code, or for verification of licensure or examination and where licensure is reciprocal with the requesting state. If you fail to disclose your social security number, you will be reported to the Franchise Tax Board, which may assess a $100 penalty against you. Individuals have the right to review their own files or records maintained by the agency, unless the records are exempt under Section 1798.40 of the Information Practices Act. You may gain access to the information by contacting the REA Program at the above address.
Copying of Documents The Registered Environmental Assessor Program authorizes the user to copy , for non-commercial use only, documents published by the Registered Environmental Assessor Program on the World Wide Web. In consideration of this authorization, the user agrees that any copy of these documents which the user makes shall retain all copyright and other proprietary notices that may be contained therein. Each individual document published by the Registered Environmental Assessor Program on the World Wide Web may contain other proprietary notices and copyright information relating to that individual document. Nothing contained herein shall be construed as conferring by implication or otherwise any license or right under any patent or trademark of the Registered Environmental Assessor Program or any third party. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or right under any Registered Environmental Assessor Program copyright.
