Characteristic Wastes: Mixture and Derived From Rules
Wastes mixed with or derived from other wastes that exhibit hazardous characteristics may be considered hazardous wastes.
Mixture Rule:1
Wastes mixed with either a RCRA or a non-RCRA characteristic hazardous waste are hazardous wastes only if the resulting mixture still exhibits a hazardous characteristic. However, intentionally mixing to avoid regulation is considered “treatment” and requires authorization from DTSC. Dilution is not the solution to avoid regulation, nor is it the solution to pollution. Dilution is considered treatment which requires authorization from DTSC.
Derived-From Rule:2
Wastes derived from the treatment, storage or disposal of either a RCRA or a non-RCRA characteristic hazardous waste are hazardous waste only if the resulting waste still exhibits a hazardous waste characteristic3.
