Enforcement

The Enforcement and Emergency Response Division (EERD) regulates facilities that generate, transport, treat, store, and/or dispose of hazardous waste. EERD monitors compliance by conducting inspections, investigations, and taking enforcement action, as appropriate. EERD pursues enforcement action for the most serious violations cited. EERD’s primary enforcement authority is granted by Health and Safety Code section 25180.

It is EERD’s policy to return violators to compliance, penalize violators, deprive violators of economic benefit gained from non-compliance, and initiate & complete enforcement actions in a consistent and timely manner.

Supplemental Environmental Projects

Many Californians live in areas disproportionately burdened by pollution.  Supplemental Environmental Projects (SEPs) provide violators an opportunity to invest in projects that extend beyond required compliance and provide tangible environmental or public health benefits to affected communities or environment. During the enforcement settlement process, the violator may voluntarily divert up to 50% of the penalty toward funding a SEP.

Penalties not directed towards SEPs, fund environmental clean-up projects across the state. SEPs may be administered by non-profit organizations, tribal governments, and local, regional, or state entities.
