Hazardous Waste Fees
The Department of Toxic Substances Control (DTSC) is the lead agency in California for hazardous waste management. DTSC enforces the state’s Hazardous Waste Control laws, issues permits to hazardous waste facilities, and mitigates contaminated hazardous waste sites. DTSC’s two primary fund accounts are the Hazardous Waste Control Account (HWCA) and the Toxic Substances Control Account (TSCA). The information below summarizes fees that support DTSC’s mandates through these two accounts.
Regulations Approved: Generation & Handling Fee Requirements
On January 27, 2025, the Office of Administrative Law approved DTSC’s regulations related to the Generation & Handling Fee Requirements. These regulations address four of the primary issues that DTSC determined led to a revenue shortfall: nonpayment and underpayment of fees, broad and inconsistent application of fee exemptions with limited oversight, limitations of data sources used to project fee revenue for rate setting, and lack of penalties to influence feepayer behavior.
These regulations are effective as of January 27, 2025, and remain in effect until DTSC amends or repeals them.

BES Votes to Raise 2024-25 Fee Rates
On August 29, 2024, the Board of Environmental Safety (BES) voted to raise the rates for the Environmental Fee, Facility Fee, and Generation & Handling Fee sufficient to create a 5% reserve in the Toxic Substances Control Account and Hazardous Waste Control Account in fiscal year 2024-25. Consistent with this vote, the BES will adopt the rates through emergency regulations. The BES expects to send the public notice to fee payers the week of September 9, 2024, and begin the 5-day comment period the following week.
