THE PROPOSAL TO LIST CHILDREN’S FOAM-PADDED SLEEPING PRODUCTS CONTAINING TDCPP OR TCEP AS A PRIORITY PRODUCT WAS APPROVED BY THE OFFICE OF ADMINISTRATIVE LAW (OAL) AND FILED WITH THE SECRETARY OF STATE ON APRIL 19, 2017. THIS REGULATION WILL GO INTO EFFECT ON JULY 1, 2017.
The proposal to list Children’s Foam-Padded Sleeping Products Containing TDCPP or TCEP as a Priority Product was approved by the Office of Administrative Law (OAL) and filed with the Secretary of State on April 19, 2017. This rulemaking adopts sections 69511 and 69511.1 in accordance with Title 22 of the California Code of Regulations regarding the identification of Priority Products. Specifically, this regulation implements “Green Chemistry” statutes, Health and Safety Code sections 25251-25257.1, which are intended to significantly reduce adverse health and environmental impacts of chemicals used in commerce. This regulation will go into effect on July 1, 2017.

THE 15-DAY PUBLIC COMMENT PERIOD FOR THE REVISED PROPOSAL TO LIST CHILDREN’S FOAM-PADDED SLEEPING PRODUCTS CONTAINING TDCPP OR TCEP AS A PRIORITY PRODUCT IS CLOSED (December 28, 2016 – January 12, 2017).
In response to comments and input from stakeholders, DTSC revised the text of the proposed regulation to correct errors and omissions and to clarify the description of the Priority Product, the hazard traits and toxicological endpoints, and the designation of the Candidate Chemicals as the Chemicals of Concern for the Priority Product. DTSC also revised corresponding sections of the Initial Statement of Reasons. In accordance with the Administrative Procedure Act, DTSC is making these revised documents available for public comment from CalSAFER, the Safer Consumer Products Information Management System.

THE 45-DAY PUBLIC COMMENT PERIOD FOR THE PROPOSAL TO LIST CHILDREN’S FOAM-PADDED SLEEPING PRODUCTS CONTAINING TDCPP OR TCEP AS A PRIORITY PRODUCT IS CLOSED (October 7, 2016 – November 21, 2016).
Due to technical difficulties with the online Safer Consumer Products Information Management System (CalSAFER) during the initial 45-day comment period, DTSC re-opened the 45-day public comment period from October 7, 2016 to November 21, 2016, to ensure that all interested persons had ample opportunity to present their written comments on the original rulemaking proposal shown below.
DTSC will consider all comments and testimonies received, in addition to any written comments received, during both comment periods. Any comments received during the re-opened comment period will be posted soon.
45-DAY PUBLIC COMMENT PERIOD FOR THE PROPOSAL TO LIST CHILDREN’S FOAM-PADDED SLEEPING PRODUCTS CONTAINING TDCPP OR TCEP AS A PRIORITY PRODUCT IS CLOSED (July 15, 2016 – August 31, 2016).
The 45-day comment period for the proposal to List Children’s Foam-Padded Sleeping Products Containing TDCPP or TCEP as a Priority Product is closed. DTSC held a public hearing at 10:00 a.m. on August 29, 2016 at the CalEPA Building on 1001 “I” Street, Sacramento, California 95814.
