Budget Change Proposal for DTSC Governance and Fiscal Reform

This proposal, part of the Governor’s 2021-22 proposed state budget, requests $22.5 million General Fund backfill for the Hazardous Waste Control Account (HWCA) and a $13 million General Fund backfill for the Toxic Substances Control Account in 2021-22. It requests $3 million from the General Fund in 2021-22 to fund a newly established Board of Environmental Safety (Board) within DTSC. The role of the Board is to set and review fees through regulation, hear permit appeals, and provide strategic guidance to the department. Costs would shift to special funds in subsequent years. The proposal also requests $300 million from the General Fund one-time in 2021-22 to accelerate progress toward the cleanup of contaminated properties and the revitalization of environmental justice communities.

DTSC Governance and Fiscal Reform Trailer Bill Language

This proposed language is intended as a trailer bill to the 2021-22 Budget Act and makes necessary statutory changes to: (1) revise the Environmental Fee rates and the hazardous waste fee rates and structure and (2) authorize the Board to set future fee rates under a capped fee-setting authority, based on appropriations by the Legislature, and make additional programmatic reforms to require DTSC to produce a contemporary Hazardous Waste Management Plan every 3 years, to expand the financial assurance requirements for facilities and sites with contamination, and to make improvements to DTSC’s permitting process.

This bill would create the Board of Environmental Safety within the California Environmental Protection Agency to provide policy direction and oversight of DTSC, restructure the HWCA and the fees deposited into it, create a Hazardous Waste Facilities Account within HWCA, and make various other changes to the statutes DTSC implements.
