Imports and Exports of Hazardous Waste

Introduction

California Code of Regulations, title 22, division 4.5, chapter 12, article 8 establishes regulations for the import and export of ResourceConservation and Recovery Act (RCRA) waste considered hazardous under Code of Federal Regulations, title 40, section 261.3, and non-RCRA hazardous waste specific to California.  Analogous hazardous waste transboundary regulations are also enforced by the U.S. Environmental Protection Agency (EPA) under 40 Code of Federal Regulations Part 262, Subpart H.  Together, these state and federal regulations ensure that hazardous waste shipped to and from this country is done so with proper approval and consent.  An overview of the Department of Toxic Substances Control’s (DTSC) Import/Export Program, applicable regulations, and helpful resources for importers and exporters of hazardous waste are provided below.

Programs

La Paz Agreement

The 1983 La Paz Agreement established bilateral coordination between the U.S. and Mexico for environmental protection along the border area of the two countries (i.e., 100 km north and south of the border).  This agreement, in turn, led to the creation of U.S. EPA’s multi-year “Border” programs (see Border 2025), as well as DTSC’s California/Mexico Border Program and the wider Import/Export Program.  Both RCRA hazardous waste and non-RCRA hazardous waste are regulated through DTSC’s transboundary programs, but with differing levels of compliance (see table below).

OECD Control System for Waste Recovery

The Organization for Economic Co-operation and Development (OECD) is an international association comprised of 38 member countries.  According to their website, the OECD provides “evidence-based international standards” and seeks to find “solutions to a range of social, economic and environmental challenges.”  Member countries adhere to the OECD’s control procedures for transboundary hazardous waste shipments which implement a two-tiered system of “green” and “amber” wastes.  More information about this classification system can be found on the OECD website, and in California Code of Regulations, title 22, section 66262.82. It is worth noting that shipments of hazardous waste between the United States and Mexico are governed by both the OECD’s control procedures and the La Paz Agreement.

Importers

Any hazardous waste importer, as defined in California Code of Regulations, title 22, section 66262.81, must comply with the standards established in California Code of Regulations, title 22, section 66262.84, as well as those in 40 Code of Federal Regulations, section 262.84.  The necessary shipping documentation, contract information, and recordkeeping requirements for hazardous waste imports are explained in these regulations (see the table below for more information).

Exporters

Any hazardous waste exporter, as defined in California Code of Regulations, title 22, section 66262.81, must comply with the export standards established in California Code of Regulations, title 22, section 66262.83, as well as those in 40 Code of Federal Regulations, section 262.83.  The necessary shipping documentation, contract information, and recordkeeping requirements for hazardous waste exports are explained in these regulations (see the table below for more information).
